Breaking News: Division Bench of Delhi HC Upholds International Exhaustion in Trademarks and Sets Aside Single Judge's Decision
Today, a Division Bench of the Delhi High Court set aside the judgment of a Single Judge delivered in Samsung Electronics v. Kapil Wadhwa on February 17, 2012. In setting aside the Single Judge's decision, the appeal of the Defendant, Mr.Kapil Wadhwa, has been allowed and the Defendant's contention that Indian Trademarks Act, 1999 follows international exhaustion, has been upheld.
